These Terms of Service ("Terms") govern your use of the Art Monster application and website (the "Service") operated by Art Monster ("we," "our," or "us"). By using the Service, you agree to these Terms.
To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account. You must be at least 13 years old to use the Service.
You retain full ownership of all artwork images and content you upload to the Service. We do not claim any intellectual property rights over your content. By uploading content, you grant us a limited license to store, display, and transmit your content solely for the purpose of providing the Service to you. You are responsible for ensuring you have the rights to any content you upload.
You agree not to use the Service to upload illegal content, infringe on others' intellectual property, distribute malware or harmful code, attempt to gain unauthorized access to other users' accounts, use the Service for any unlawful purpose, or abuse or overload the Service infrastructure.
The Service offers a free plan limited to 15 artworks. Paid plans are available through in-app purchase and are subject to the pricing displayed at the time of purchase. Subscriptions are billed through Apple's App Store and are governed by Apple's terms. You can manage or cancel your subscription through your Apple ID settings.
We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We reserve the right to modify or discontinue features of the Service with reasonable notice.
You may delete your account at any time through the app's settings menu. We may suspend or terminate accounts that violate these Terms. Upon account deletion, your data including all uploaded artwork will be permanently removed.
The Service is provided "as is" without warranties of any kind. We are not liable for any loss of data, including artwork images, though we take reasonable precautions to protect your data. Our total liability for any claims related to the Service is limited to the amount you paid for the Service in the 12 months prior to the claim.
We may update these Terms from time to time. We will notify you of material changes by posting updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law provisions.
